Michael Crichton Estate Wins Appeals Court Ruling Over The Pitt
November 5, 2026 · 2 sources
A California appeals court just ruled that the medical drama The Pitt shares clear and numerous similarities with the nineties hit ER. Warner Bros tried to toss the lawsuit by arguing the shows only shared generic emergency room traits. But a three-judge panel reviewed both pilot scripts and found enough overlap in plot, dialogue, and pacing to keep the case alive. Sherri Crichton first filed the breach of contract suit in August twenty-four after talks to officially reboot ER fell apart. The estate claims Warner Bros simply moved the setting from Chicago to Pittsburgh and dropped the original title. Noah Wyle and John Wells have denied the allegations and called the complaint meritless. The appeals panel actually dismissed claims against individual producers and showrunners like R. Scott Gemmill due to a lack of evidence. Even so, the main case now heads toward a jury trial with the next hearing scheduled for January twenty-first. One outlet notes a trial could happen as early as next summer unless the bitter parties settle first.
